This Privacy Policy (“Policy”) explains how we collect, use, disclose, store, and protect personal information when you use our website, calculator, dashboard, and cross-border payment services (the “Services”).

This Policy is intended to support compliance with applicable Canadian privacy requirements, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and related principles.

2) Scope

This Policy applies to personal information we collect:

  1. through www.myfx.ca (including the calculator and dashboard),
  2. when you create an account or place Orders,
  3. when we communicate with you (email, support, WhatsApp),
  4. and when we conduct verification and compliance checks.

“Personal information” means information about an identifiable individual (e.g., name, date of birth, contact information, ID details).

3) Who can use MyFX.ca

Our Services are intended for adults. Minors (under 18) should not use our Services or submit personal information.

4) What we collect

We collect information to provide cross-border payment services, operate the website, prevent fraud, and meet legal obligations.

A) Information you provide
  1. Identity & contact: name, date of birth, address, email, phone number
  2. Account info: login details (stored securely), settings/preferences
  3. Verification details: government ID images/details (e.g., passport or driver’s licence), selfies/liveness checks (where used), and other KYC information
  4. Payment and transaction info: amounts, currencies, recipient details, bank/payment identifiers needed to process transfers (e.g., account details, routing/rail info), transaction references
  5. Business customers (KYB): business registration info, directors, beneficial owners, signing authorities, and supporting documents (e.g., incorporation documents)
B) Information about recipients (third parties)

If you provide recipient information to complete a transfer (e.g., name, bank details, address, phone/email), we use it only to process your requested transaction and for compliance/fraud prevention as needed.

C) Information collected automatically
  1. device and browser data, IP address, approximate location (derived), logs
  2. usage data: pages visited, time spent, clicks, errors, and performance data
  3. cookies and similar technologies (see Section 10)
D) Information from third parties

We may receive information from:

  1. identity verification providers, database checks, sanctions/PEP screening tools, fraud prevention vendors
  2. banks, payment partners, and service providers used to complete transfers
  3. lawful sources where permitted/required (e.g., compliance-related information)

5) Why we collect and use your information

We use personal information for the following purposes:

A) Provide and operate the Services
  1. create and manage your account
  2. generate quotes and show calculator estimates
  3. process Orders, payments, and delivery to recipients
  4. provide customer support and communicate service updates
B) Verification, AML/CTF compliance, and risk controls
  1. verify identity (KYC/KYB) and keep records
  2. conduct AML screening and transaction monitoring
  3. detect and prevent fraud, scams, account takeover, and misuse
  4. comply with legal and regulatory obligations (including recordkeeping and reporting requirements applicable to MSBs)
C) Improve and protect MyFX.ca
  1. troubleshoot issues, improve performance, maintain security
  2. analytics to understand usage and improve user experience
D) Marketing (optional)
  1. send promotions or product updates where permitted by law and subject to your preferences/unsubscribe options.

6) Consent and legal bases (how we’re allowed to use data)

We generally collect, use, and disclose personal information with your consent, except where the law permits or requires otherwise (for example, certain fraud prevention and legal compliance situations).

You may withdraw consent in some cases; however, withdrawal may limit or prevent us from providing Services (especially where information is required for compliance or transaction processing).

7) How we share personal information

We do not sell your personal information.

We may share personal information with:

  1. Payment and banking partners to process your transfer (collection/delivery rails)
  2. Verification and compliance providers (KYC/KYB, screening, fraud monitoring, security)
  3. IT and operations vendors (hosting, analytics, customer support tools)
  4. Professional advisors (legal, audit, accounting) where necessary
  5. Authorities / law enforcement where we are required or permitted by law, including in response to lawful requests, court orders, or to meet reporting obligations

We require service providers to use personal information only to perform services for us and to protect it with appropriate safeguards.

8) Cross-border processing and storage

Your information may be processed or stored in Canada and may also be processed by trusted third-party service providers in other jurisdictions (for example, where certain verification or infrastructure providers operate). When information is handled outside Canada, it may be subject to the laws of that jurisdiction.

9) Retention (how long we keep your information)

We retain personal information only as long as necessary for the purposes described in this Policy, including to:

  1. provide the Services,
  2. resolve disputes,
  3. enforce agreements, and
  4. meet legal/compliance obligations.

For MSB-related records, retention periods can be at least 5 years for certain records/reports, consistent with FINTRAC recordkeeping guidance.

When information is no longer required, we securely destroy, delete, or anonymize it.

  1. essential site functionality and security (e.g., authentication)
  2. remembering preferences
  3. analytics to improve the website
  4. fraud prevention and risk signals
