TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern your access to and use of the MyFX.ca website, calculator, user dashboard, and cross-border payment services (the "Services"). By creating an account, submitting an order, or using the Services, you agree to these Terms.
1) Who we are

2) Definitions
- "Customer", "you", "your" means any individual or business using the Services.
- "Order" means your request to send money cross-border (including the currency pair, amount, recipient, and delivery method).
- "Recipient" means the person or business receiving the transfer.
- "Calculator" means the MyFX.ca tool that provides estimated rates, fees, and receive amounts.
- "Quote" means the on-screen rate, fees, and payment window shown for a specific Order.
- "Payment Window" means the time period your Quote remains valid, as shown onscreen. For MyFX.ca, the Payment Window is 30 minutes from the time the Quote is issued (unless otherwise stated on-screen).
3) What the service is
MyFX.ca provides cross-border payments for:
- Personal transfers (friends and family support), and
- Business payments (payments for goods and services),
subject to availability, partner/bank coverage, compliance checks, and these Terms.
4) Supported currencies and delivery methods
MyFX.ca supports cross-border transfers involving these currencies (availability may vary by corridor and payout type): USD, CAD, EUR, GBP, NGN, MXN, BRL.
Delivery methods supported today (where available):
- USD: ACH and Wire
- CAD: Interac e-Transfer and EFT
- EUR: Instant SEPA
- GBP: Faster Payments
- NGN: Bank transfer
- BRL: PIX
- MXN: SPEI
Not all currency pairs, corridors, or delivery methods are available at all times. We may add, remove, or restrict corridors based on operational coverage, banking/partner constraints, risk, or regulatory requirements.
5) Quotes, calculator estimates, and transparent fees
5.1 Calculator estimatesThe MyFX.ca Calculator provides estimates based on available pricing inputs at that time. Calculator outputs are not binding and may differ from the final Quote shown during Order creation.
5.2 On-screen Quotes (binding for the Payment Window)When you initiate an Order in your dashboard, we display a Quote that includes:
- the exchange rate for the selected currency pair,
- the service fee(s),
- the amount you pay and the amount the Recipient receives (where shown),
- the Payment Window (30 minutes).
Fees are displayed on-screen:
- during Order initiation (Quote screen), and
- when using the MyFX.ca Calculator to understand pricing.
We do not rely on hidden fees. Bank/partner return fees or third-party charges may apply in some cases and are handled under Section 9.
5.4 Rate methodologyRates generally reference a market rate and may include a markup/spread to cover costs and margin. The Quote rate applies only if you fund within the Payment Window and your transaction passes compliance controls.
6) Compliance, identity verification, and AML controls
6.1 Compliance-gated transactionsAll transactions are compliance-gated: MyFX.ca confirms KYC completion and applies AML screening before allowing the Customer to proceed with a transaction.
6.2 Identity verification and business verificationYou must provide accurate information and complete identity verification (and, for businesses, business verification and beneficial ownership information) when required. We may request additional information at any time (for example, invoices/contracts for business payments, source of funds/source of wealth, or Recipient verification).
6.3 Monitoring and reportingAs a reporting entity registered with FINTRAC, we monitor transactions and may be required to submit regulatory reports (including suspicious transaction reports where applicable).
6.4 Sanctions and restricted partiesWe may screen Customers, Recipients, and transactions against applicable sanctions and watchlists. We may block, pause, reject, or cancel transactions where required.
7) How a transaction is processed
A typical transaction flow is:
- You create an Order and receive an on-screen Quote (rate + fees + Payment Window).
- Compliance gate checks run (KYC confirmed + AML screening).
- You fund the Order using the payment instructions shown.
- We receive funds and match them to your Order (amount/reference/sender)
- We validate Payment Window timing:
- Within window: we proceed to FX execution and payout.
- Late (expired): the Order is not processed at the expired Quote and funds are handled under Section 9.
- We execute delivery to the Recipient using the selected/available delivery method.
- We update your dashboard status and may send email notifications.
8) Customer responsibilities
You agree to:
- provide accurate personal/business details and Recipient information,
- follow payment instructions exactly (including reference fields where provided),
- ensure you have the legal right to send the funds and that funds come from lawful sources,
- respond promptly to requests for verification or transaction clarification.
9) Late payments, cancellations, refunds, failed transfers, and returns
9.1 Payment Window and late funding (30 minutes)If funding is received after the Payment Window expires, the transaction will not be processed using the expired Quote. In such cases, we will refund the funds in accordance with these Terms, subject to Section 9.4.
9.2 Failed transfers and incorrect Recipient detailsIf a transfer fails or is returned due to incorrect Recipient details or bank/partner rejection, we will:
- notify you via dashboard and/or email, and
- either reattempt delivery (if possible and permitted) or process a refund.
We may pause, reject, or cancel an Order during compliance review. Where permitted, we will provide status updates, but we may not be able to disclose details in some cases.
9.4 Third-party fees and pass-through chargesIf banks or payment partners charge fees to us (for example, return, rejection, or processing fees), those fees may be passed through to you. Where applicable, they may be deducted from the refund amount.
9.5 Refund timingRefunds are processed back to the original funding source where possible and may take time depending on banks/partners and payment rails. We will aim to process refunds promptly.
10) Limits and service availability
We may apply transaction, daily, corridor, and velocity limits. Limits may change due to compliance requirements, risk, fraud prevention controls, partner constraints, and operational considerations.
11) Dashboard statuses
Your dashboard may display one or more of the following statuses:
- Pending Funding: Order created, awaiting your payment.
- Received Funding: Your payment has been received and is being matched/validated.
- Processing: FX and/or payout execution is in progress.
- Completed: Recipient has been paid (or the payout is confirmed sent, depending on rail).
- efunded: Funds have been refunded (net of third-party fees if applicable).
- Compliance Hold: Temporarily paused for verification or compliance review.
12) Records and retention
We maintain records as required by law and may retain transaction and identity verification information for regulatory compliance and audit purposes.
13) Privacy and communications
- Privacy: Your personal information is handled according to our Privacy Policy: [Insert link].
- Communications: We may contact you via dashboard notifications and email using the contact details you provide.
14) Disclaimers
- We do not provide legal, tax, or investment advice.
- Exchange rates can change rapidly. Calculator results are estimates. Quotes are valid only for the Payment Window.
15) Limitation of liability
To the maximum extent permitted by law, MyFX.ca is not liable for indirect, incidental, special, or consequential damages. Our total liability for a claim related to a transaction is limited to the fees you paid MyFX.ca for that transaction, unless prohibited by law.

17) Changes to these Terms
We may update these Terms from time to time. The updated Terms will be posted on MyFX.ca with a new effective date.
18) Governing law
These Terms are governed by the laws of Ontario, Canada and applicable federal laws of Canada.
